1. Introduction

Welcome to DiaspoMeet. These Terms of Service (“Terms”) govern your use of the DiaspoMeet website and services (the “Platform”). By accessing or using DiaspoMeet, you agree to be bound by these Terms. If you do not agree, please do not use our Platform.

2. Definitions

  • “User” means any person who accesses or uses the Platform.
  • “Organizer” means a User who creates and hosts events on the Platform.
  • “Event” means any gathering, activity, or experience listed on the Platform.
  • “Content” means any text, images, videos, or other materials submitted to the Platform.

3. Account Terms

To access certain features, you must create an account through our authentication provider (Clerk). You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

You must be at least 18 years old to create an account and use the Platform.

4. Event Hosting

Organizers who submit events agree to:

  • Provide accurate, complete, and truthful event information
  • Comply with all applicable laws and regulations for their events
  • Obtain necessary permits, licenses, and insurance for their events
  • Respond to attendee inquiries in a timely manner
  • Honor all commitments made in their event listings

DiaspoMeet reserves the right to review, approve, or remove any event listing at our sole discretion. We may remove events that violate these Terms or our community guidelines.

5. User Conduct

You agree not to:

  • Post false, misleading, or fraudulent content
  • Harass, abuse, or discriminate against other users
  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Attempt to gain unauthorized access to the Platform or other accounts
  • Use the Platform for spam or unauthorized commercial purposes
  • Upload malicious code or interfere with Platform operations

6. Payment Terms

For events with ticketing or payment features:

  • Payments are processed securely through Stripe
  • DiaspoMeet does not store your credit card information
  • Refund policies are determined by individual event organizers
  • DiaspoMeet may charge service fees for certain transactions

Disputes regarding refunds should be directed to the event organizer first. DiaspoMeet is not responsible for disputes between attendees and organizers.

7. Intellectual Property

The DiaspoMeet name, logo, and all related marks are our trademarks. All Platform content, features, and functionality are owned by DiaspoMeet and protected by copyright and other intellectual property laws.

By submitting Content to the Platform, you grant DiaspoMeet a non-exclusive, worldwide, royalty-free license to use, display, and distribute your Content in connection with the Platform.

8. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Disclaimers

DiaspoMeet is a platform that connects event organizers with attendees. We are not responsible for:

  • The quality, safety, or legality of events listed on the Platform
  • The accuracy of event information provided by organizers
  • The conduct of organizers or attendees at events
  • Any personal injury or property damage occurring at events

THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIASPOMEET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

11. Indemnification

You agree to indemnify and hold harmless DiaspoMeet and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform will immediately cease.

13. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on the Platform. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of Ontario, Canada.
